NEW CITY ORDINANCE PROHIBITS ROADSIDE SOLICITATIONS

New city ordinance prohibiting the distribution of handbills, etc., the solicitation of contributions, and the sale of merchandise or services on highways, public roadways and medians.

Due to safety concerns related to the increased number of groups and individuals participating in fundraising activities at intersections and along roadways, the Newport News City Council recently passed a new city ordinance prohibiting the distribution of handbills, etc., the solicitation of contributions, and the sale of merchandise or services on highways, public roadways and medians.

This new ordinance will take effect on July 1, 2010. A violation of the provisions of this ordinance will constitute a traffic infraction.

The General Assembly amended State Code 46.2-931 which, effective July 1, 2010, allows local jurisdictions to prohibit or regulate the distribution of handbills, solicitation of contributions, and sale of merchandise or services within their boundaries or on public roadways, and medians.

CHAPTER 26

MOTOR VEHICLES AND TRAFFIC

ARTICLE VIII. PEDESTRIANS


Sec. 26-215. Distribution of handbills, etc., solicitation of contributions, and sale of merchandise or services on highways, public roadways, and medians prohibited.


(a) The following acts are prohibited:


(1) The distribution of handbills, leaflets, bulletins, literature, advertisements, or similar material to the occupants of motor vehicles on highways located within their its boundaries or on public roadways and medians;

(2) The solicitation of contributions of any nature from the occupants of motor vehicles on highways located within its boundaries or on public roadways and medians; and

(3) The sale of merchandise or services or the attempted sale of merchandise or services to the occupants of motor vehicles on highways located within their its boundaries or on public roadways and medians.


(b) Ordinances adopted pursuant to this section may provide that any person violating the provisions of such ordinances shall be guilty of a traffic infraction as set forth in City Code Section 26-6.


2. That this ordinance shall be in effect on and after July 1, 2010.
