Circuit Court Local Rule 01-1 Pretrial Conference

Memorandum Order

Local Rule 01-1

       Whereas, in order to effectuate the final pretrial conference as authorized by Rule 1:19, Rules of the Supreme Court of Virginia, it is necessary to establish a procedure for the setting of the pretrial conference date and to order the exchange between or among the parties and the submission to the court of certain relevant written documents; and

      Whereas, an order in each applicable case would not violate the provisions of Section 8.01-4, Code of Virginia, 1950, as amended, and would not abridge the substantive rights of the parties nor deprive any party of the opportunity to present its position as to the merits of the case, it is hereby Ordered that in all civil cases set for trial, pursuant to Rule 1:19, Rules of the Supreme Court of Virginia, all pro se parties and/or counsel of record in a case shall schedule with the appropriate court a final pretrial conference to be heard no more than fourteen (14) and no less than three (3) days prior to trial, and shall exchange with one another and file with the court no less than 10 days prior to the scheduled final pretrial conference (i) a list of proposed witnesses, (ii) a list of proposed exhibits, (iii) proposed jury instructions (if jury), and (iv) proposed voir dire questions (if jury). Pursuant to Rule 1:15, the original of this Memorandum Order shall forthwith be spread upon the Order Book and an attested copy shall be (1) posted in the Clerk's Office, (2) filed with the Executive Secretary of the Supreme Court of Virginia, and (3) furnished to Chesapeake, Hampton, James City County-Williamsburg, York County, Newport News, Norfolk, Portsmouth, Richmond and Virginia Beach Bar Associations for dissemination.

       Pursuant to Rule 1:15, the original of this Memorandum Order shall forthwith be spread upon the Order Book and an attested copy shall be (1) posted in the Clerk's Office, (2) filed with the Executive Secretary of the Supreme Court of Virginia, and (3) furnished to Chesapeake, Hampton, James City County-Williamsburg, York County, Newport News, Norfolk, Portsmouth, Richmond and Virginia Beach Bar Associations for dissemination.
